Registrant Liability Statement

The following is a legal statement which means that anyone who is registered or attend LDSEHE conferences and activities accept all risk and expenses for attending and participating in LDSEHE conferences and activities, including accidental or incidental happenings.

As an informal explanation, LDSEHE will not be responsible for any damage or injury, offense or loss you may incur at the conference or associated activities. LDSEHE urges registrants and participants to use great caution in your participation and at all times to protect your family, your possessions and your own person from anything harmful. Please inform your youth. Do not expect that anyone else is watching out for you or your family.

Please read the statement below – registering constitutes your acceptance.

 

The registrant and participant is herewith notified that the conferences and activities of LDSEHE are attended by families composed of adults and youth and children. All participants in LDSEHE conferences and activities must abide by LDSEHE rules for participation and registration as listed in LDSEHE publications. LDSEHE will strive to provide a safe environment and social climate for their conference and activities and will at times direct activities or the conference in a way other than previously posted to maintain the safety of participants. Notwithstanding the preceding sentences, the registrant willingly and freely registers and hereby assumes any and all risk, with respect to any liability of LDSEHE for such risk, including without limitation risk of any accident or injury to person or property which one may sustain in connection with their participation or attendance in any LDSEHE related conference or activity.

By registering for LDSEHE conference and the associated activities, the registrant(s) assumes all risks associated with participation and attendance in the conference and associated formal or informal activities, including but not limited to theft, injuries, damage or loss to personal property. Nor will the registrant(s) hold LDSEHE liable for any direct, indirect, punitive, special, incidental, or consequential damages, including, without limitation, lost revenues, or lost profits, arising out of or in any way connected with the LDSEHE conference or activities.

The registrant/participant(s) releases directors, officers, partners, agents, employees, successors, assigns, licensees, sponsors, donors, representatives, guests and affiliates from and covenants not to sue LDSEHE for, any and all claims and causes of action, whether known or unknown, arising out of, based upon or relating to participation and attendance in any LDSEHE conference activity or project. The registrant/participant hereby acknowledges that the LDSEHE conference and associated activities involve individuals and families including youth and children of all ages.

The registrant/participant further irrevocably grants to LDSEHE, its assigns and successors, consent and full right to: use the registrant's/participant's photograph, likeness, image, and voice in any and all media, publications, advertising, and publicity, in connection with their participation hereunder.

This release shall inure to your benefit, as well as to the benefit of your successors, licensee, agents, employees, affiliates and assigns. This release shall be governed by the laws of the State of Virginia.

Notwithstanding the acceptance of the release of liability as written above, if a situation arises the registrant/participant agrees that he/she shall indemnify any director,officer, volunteer, or any former director or officer of the home schooling group referred to as LDSEHE or any person who is or has served at the request of the LDSEHE as a director, officer or volunteer ,against expenses, including attorneys' fees, judgments, fines and amounts paid in settlement, actually and reasonably incurred by him by reason of the fact that he is or was such director, officer, volunteer in connection with any threatened, pending or completed action, suit or proceeding, whether civil, criminal, administrative or investigative, to the full extent and according to the procedures and requirements and Laws set forth in the Commonwealth of Virginia.

The same may be in effect from time to time, provided that he acted in good faith and in a manner he reasonably believed to be in or not opposed to the best interest of the LDSEHE, and with respect to any criminal action or proceeding, had no reasonable cause to believe his conduct was unlawful. 
The indemnification provided for herein shall not be deemed to restrict the right of LDSEHE to 
(i)         indemnify employees, agents and others as permitted by such Law, 
(ii)        purchase and maintain insurance or provide similar protection on behalf of the directors, officers, or such other persons against liabilities asserted against them or expenses incurred by them arising out of their service to LDSEHE as contemplated herein.
